These Terms and Conditions ("Terms") govern your use of the website, services, and products provided by ZeroPoint Ammo, LLC ("ZeroPoint," "we," "us," or "our"), a Texas limited liability company. By accessing our website, creating an account, or subscribing to our services, you agree to be bound by these Terms.

1. Eligibility

You must meet the following requirements to use our services:

• You must be at least 18 years of age (or 21 where required by local law).
• You must be legally permitted to purchase and possess ammunition under all applicable federal, state, and local laws.
• You must provide a valid delivery address within our active service area (currently the greater Austin, TX area).
• You must not be a prohibited person under 18 U.S.C. § 922 or any applicable state law.

By placing an order or subscribing, you represent and warrant that you meet all eligibility requirements. ZeroPoint reserves the right to refuse or cancel service to anyone at our sole discretion.

2. Subscription Service

How It Works

ZeroPoint operates an ammunition subscription and delivery service. When you subscribe, you select your calibers, round counts, and delivery frequency. We manufacture your ammunition at our Texas facility and deliver it to your door on a recurring schedule.

Minimum Order

All subscriptions require a minimum of 200 rounds per delivery. Rounds are ordered in multiples of the product's quantity step (typically 20 or 50 rounds depending on caliber).

Delivery Frequency

Subscriptions are available in weekly, biweekly, and monthly delivery frequencies. You may change your delivery frequency by contacting us or through your subscriber portal.

Free Delivery

Free delivery is included for all active subscriptions within our designated delivery zone. Delivery outside the service area may be available at additional cost through our online store (when available).

Subscription Modifications

You may modify your caliber selections, round counts, or delivery frequency at any time through your subscriber portal or by contacting support. Changes take effect on your next scheduled delivery.

Cancellation

You may cancel your subscription at any time. There are no cancellation fees, long-term contracts, or hidden charges. Cancellation takes effect after your current billing cycle. Any ammunition already manufactured for your next delivery will be delivered as scheduled.

3. Pricing and Payment

• Prices are listed per round and may vary by caliber and product type.
• We reserve the right to adjust pricing with 30 days' notice to subscribers.
• Payment is due according to your billing schedule. Invoices are issued prior to each delivery cycle.
• Past-due accounts may have deliveries suspended until payment is received.
• All prices are in US dollars and do not include applicable taxes, which will be added where required by law.

4. Delivery

Delivery Area

Our free delivery service operates within the greater Austin, TX metropolitan area, including but not limited to Austin, Round Rock, Cedar Park, Leander, Georgetown, Pflugerville, Hutto, and Liberty Hill. You can verify your ZIP code at zeropointammo.com.

Delivery Process

Ammunition is delivered to the address on file for your subscription. Deliveries are made by ZeroPoint drivers during normal business hours. You will receive notifications when your delivery is out for delivery and upon completion.

Proof of Delivery

Our drivers may photograph the delivered package as proof of delivery. These images are stored securely and accessible through your subscriber portal.

Failed Deliveries

If a delivery cannot be completed (access issues, unsafe conditions, etc.), we will notify you and reschedule. Repeated failed deliveries may result in subscription suspension.

Safe Storage

You are responsible for the safe and secure storage of all ammunition upon delivery. ZeroPoint is not liable for any loss, theft, or misuse of ammunition after delivery is confirmed.

5. Products

Manufacturing

ZeroPoint ammunition is manufactured at our Texas facility using premium automated presses with digital powder scales. We stand behind the consistency and quality of every round we produce.

Product Warranty

All ZeroPoint ammunition is warranted to be free from defects in materials and workmanship. If you receive defective ammunition, contact us immediately. We will replace the defective rounds at no charge.

No Returns on Ammunition

Due to the nature of ammunition products and federal regulations, we cannot accept returns on ammunition that has left our facility, except in cases of verified manufacturing defects.

Lot Consistency

We take pride in lot-to-lot consistency. While minor variations in velocity and performance are inherent in ammunition manufacturing, we maintain tight tolerances and consistent processes to minimize variation.

6. Communications and Notifications

Mandatory Communications (Cannot Be Opted Out)

By creating an account or subscribing, you agree to receive the following essential communications via email. These are required for the operation of your account and cannot be disabled:

• Delivery notifications: Out-for-delivery alerts, delivery confirmations, failed delivery notices, and backorder updates.
• Account notifications: Password resets, account security alerts, and subscription status changes (activation, cancellation, suspension).
• Billing notifications: Invoices, payment confirmations, payment failures, and past-due reminders.
• Legal and policy updates: Changes to these Terms, our Privacy Policy, or other legal notices.

Optional Communications (Opt-In)

With your consent, we may also send:

• SMS notifications: Text message versions of delivery and account alerts. SMS is opt-in only — you will not receive text messages unless you explicitly enable them in your subscriber portal. You may opt out at any time. Message and data rates may apply.
• Marketing emails: Product announcements, new caliber launches, promotions, and community updates. You may unsubscribe at any time via the link in any marketing email.

Communication Preferences

You can manage your notification preferences — including SMS opt-in/out and per-event-type toggles — through your subscriber portal at zeropointammo.com/zero/ or by contacting support.

7. Account Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• We use PBKDF2 password hashing and encrypted connections to protect your account.
• We are not liable for losses resulting from unauthorized use of your credentials.

8. Acceptable Use

You agree not to:

• Purchase ammunition for resale without our written authorization.
• Provide false or misleading information in your account or subscription.
• Use our services for any unlawful purpose.
• Attempt to circumvent delivery area restrictions.
• Interfere with or disrupt our website, API, or services.
• Scrape, crawl, or harvest data from our systems without permission.

9. Intellectual Property

All content on our website — including text, graphics, logos, images, and software — is the property of ZeroPoint Ammo, LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Dealer and Partner Program

Dealers and partners who participate in our referral or kiosk program are bound by separate dealer agreements. Customer subscriptions attributed to a dealer may generate commissions as outlined in the applicable dealer agreement. Dealer relationships do not create any agency, partnership, or joint venture with ZeroPoint.

11. Limitation of Liability

To the maximum extent permitted by law:

• ZeroPoint is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services.
• Our total liability for any claim shall not exceed the amount you paid to ZeroPoint in the 12 months preceding the claim.
• We are not liable for delays or failures in delivery caused by weather, road conditions, vehicle issues, or other circumstances beyond our reasonable control.

12. Indemnification

You agree to indemnify, defend, and hold harmless ZeroPoint Ammo, LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or violation of any law or regulation.

13. Dispute Resolution

Any dispute arising from these Terms or your use of our services shall be governed by the laws of the State of Texas, without regard to conflict of law principles. You agree that any legal action shall be brought exclusively in the state or federal courts located in Travis County, Texas.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through your subscriber portal. Continued use of our services after changes constitutes acceptance. If you do not agree with updated Terms, you may cancel your subscription.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZeroPoint Ammo, LLC regarding your use of our services.
